The Cosmopolitan State

H. Patrick Glenn (1940-2014), ένας από τους σπουδαιότερους "εκπροσώπους" του Συγκριτικού Δικαίου. Άφησε εποχή το έργο του για τις Νομικές Παραδόσεις του Κόσμου (Legal Traditions of the World) και πλέον αποτελεί μια από τις πλέον ενδιαφέρουσες προσεγγίσεις Συγκριτικού Δικαίου.

Το τελευταίο του βιβλίο ήταν το "The Cosmopolitan State", Oxford University Press, 2013. Από το βιβλίο αυτό παραθέτω κάποια ελάχιστα δείγματα της πολύ σημαντικής σκέψης του.



"Traditions are the objects of handing down, of traditio, but it is normative information that is the substance of tradition. To the extent that states exist in institutional form, they so exist because there is normative information that favours institutionalization. Western institutions did not simply spring up on their own; there were underlying ideas of human control over human destiny, and of how that control was best brought about. They were ideas developed and refined over centuries, and handed down. This has consequences for our thinking about the state, consequences that are becoming clearer in present circumstances." (p. 9)




"States vary, however, not only in the degrees of their acceptance by populations, but also in their type and structure, and these differences are primarily legal. The great variety of contemporary states is an indication of the cosmopolitan character of the state tradition, and its internal variety. The state tradition, like any tradition, 'tolerates and unites an internal variety and displays an ability to change without losing its identity'." (p. 12)




Το βιβλίο κλείνει με αυτά τα λόγια:

"The cosmopolitan character of the contemporary state also explains much of its present operation. The state creates law but state law cannot replace, and often does not purport to replace, legal traditions that precede, justify, and continue to surround the law of the state. Nor can state law displace in their entirety legal traditions that are less compatible with state law. In all cases, however, we are dealing with legal information and, while individual pieces of information may be incompatible with one another, this form of contradiction does not necessarily yield conflict. The French philosophers Deleuze and Guattari once wrote that 'no one has ever died of contradictions' and the statement is an affirmation of the human capacity to overcome contradictions and to avoid human conflict. Cosmopolitan legal thought may therefore seek to provide consistency and legal certainty where possible, but may also be paraconsistent in character where necessary. The new paraconsistent logics appear to be an important ally in this process." (p. 291)



Οι φωτογραφίες είναι από το ταξίδι μου για το συνέδριο στον Βόλο. Τράβηξα τις 2 την πρώτη ημέρα που είχε ήλιο και τις άλλες 2 τη δεύτερη, που είχε συννεφιά - πολύ επώδυνη για όσους έχουμε ορθοπεδικά προβλήματα αλλά πάντα πιο ρομαντική!!!




Το είχα παραγγείλει και για το Σπουδαστήριο ΙΔΔ και ΣΔ, αλλά φαίνεται πως κόλλησε η παραγγελία λόγω έλλειψης χρημάτων...
